Trading Terms & Conditions for Wicking Beds by Very Edible Gardens

These trading terms & conditions (“Terms”) govern the purchase of goods from Very Edible Gardens PTY LTD (“VEG”) trading as Wicking Beds by Very Edible Gardens. By purchasing goods from VEG, you agree to these Terms.

  1. Definitions In these Terms:

    1. “Goods” means the plastic liners, plumbing, and other products sold by VEG.
    2. “Customer” means the person or entity purchasing Goods from VEG.
    3. “Australian Consumer Law” means the Australian Consumer Law as set out in the Competition and Consumer Act 2010 (Cth).
    4. “Sendle” means the courier company used by VEG for deliveries.

  2. Orders and Payment

    1. Orders can be placed on the VEG website, via email, or over the phone.
    2. Payment must be made at the time of placing the order via credit card, PayPal, or direct bank transfer.
    3. VEG reserves the right, at its sole discretion, to refuse or cancel any order for any reason, including but not limited to the unavailability of a product, an error in the price or product description, or an error in the order. In such cases, VEG will provide a full refund of any payments made for the order.
  3. Delivery

    1. VEG offers free pickup of Goods from its Melbourne location, postage Australia wide for standard sized wicking kits, and delivery for timber garden beds within a certain radius of Melbourne.
    2. Delivery fees for timber garden beds will be quoted at the time of order and must be paid prior to delivery.
    3. Delivery times are estimates only and VEG is not liable for any delays or damages that occur during delivery.
  4. Returns and Refunds

    1. Standard wicking kit sizes that are unopened and undamaged may be returned for a refund within 30 days of purchase, but the cost of returning the product to us is the responsibility of the customer. Customers must keep receipts of the postage or transportation costs incurred in returning the product to us. If the product is later confirmed to be faulty, whether major or minor, we will reimburse the reasonable postage or transportation costs incurred by the Customer in returning the product to us.
    2. Custom liners are non-refundable, except in cases where the product is faulty or not as described.
    3. Refunds will be processed within 7 business days of receipt of the returned product.
    4. Refunds will be made to the original payment method used to purchase the product, excluding the cost of postage or delivery.
    5. We do not offer refunds or exchanges for change of mind, ordering the wrong product, finding the product cheaper or better elsewhere, being aware of a relevant fault before buying, damaging the product by misuse, or using the product for a long time resulting in usual wear and tear. However, we may still choose to offer a refund, exchange, or credit note in some of these situations at our discretion.
  5. Warranty and Liability

    1. VEG provides a warranty that its Goods will be free from defects for a period of 12 months from the date of purchase.
    2. In the event of any breach of the warranty, VEG’s liability shall be limited to either replacing or repairing the defective goods, or providing a refund for the purchase price at its sole discretion.
    3. VEG is not liable for any loss or damage that arises from the use of its Goods, except where such loss or damage is caused by VEG’s negligence or breach of the Australian Consumer Law.
  6. Tracking & Lost Packages

    1. Customers can track their packages via the tracking information provided by Sendle. If a package has not been delivered within the estimated delivery time or there is no tracking information available, customers should contact VEG immediately for assistance.
    2. VEG takes all reasonable measures to ensure that packages are delivered to customers in a timely and efficient manner. However, in the rare event that a package is lost in transit, VEG will take all necessary measures to locate the package with the Sendle. If the package cannot be located, VEG will take steps to resolve the issue by filing a claim with the courier company and arranging for a replacement shipment to be sent to the customer.
    3. VEG is not responsible for lost or stolen packages once they have been delivered to the shipping address provided by the customer. It is the customer’s responsibility to ensure that the shipping address provided is accurate and secure. 
    4. If a package is confirmed as delivered by Sendle but the Customer has not received it, the Customer should contact Sendle directly to initiate an investigation and file a claim.
  7. Invoicing and Payment

    1. Invoices will be sent via email at the time of purchase.
    2. Payment must be made in full at the time of purchase, except where VEG has agreed to provide credit to the Customer.
    3. The Customer is responsible for any bank fees or charges that arise from the payment of Goods.
  8. Additional Charges

    1. The Customer is responsible for any additional charges that arise from the purchase of Goods, including but not limited to delivery fees, customs duties, and taxes.
  9. Acceptance of Goods

    1. The Customer must inspect the Goods upon receipt and notify VEG of any defects or damages within 14 days of receipt.
    2. The Customer is deemed to have accepted the Goods if they do not notify VEG of any defects or damages within this time period.
  10. Indemnity

    1. You agree to indemnify and hold harmless VEG and its directors, officers, employees, and affiliates from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to your use of the products or services provided by VEG, your violation of these Terms.
    2. VEG will make reasonable efforts to provide accurate and reliable information, but it does not guarantee the accuracy, completeness, or timeliness of any information provided. You acknowledge that any reliance on such information will be at your own risk. In no event shall VEG be liable for any direct, indirect, special, punitive, incidental, or consequential damages arising out of or in connection with your use of the products or services provided by VEG.
  11. Australian Consumer Law

    1. VEG is committed to complying with the Australian Consumer Law (ACL). The ACL is a national law that provides consumer protections for purchases made in Australia. Under the ACL, consumers have certain rights, including the right to refunds, repairs or replacements for faulty products, and the right to receive products that are of acceptable quality, fit for purpose and as described.
    2. If you believe that your rights under the ACL have been breached, please contact VEG as soon as possible. We will work with you to resolve any issues or concerns you may have in a timely and fair manner. We may ask for further information from you to assist in the investigation of any issues.
    3. Please note that the ACL provides consumer protections for purchases made in Australia. If you are located outside of Australia, your consumer rights may be different. Please refer to the consumer protection laws in your country for more information.
  12. Other

    1. VEG may amend these Terms at any time by publishing the amended Terms on its website.
    2. These Terms are governed by the laws of the state of Victoria, Australia, and the parties submit to the jurisdiction of the courts of Victoria, Australia.
    3. These Terms constitute the entire agreement between the parties and supersede all prior agreements, understandings, and negotiations.
